Abstract (Arabic): طبيعة الرقابة الشرعية مراقبة الاسشارات المالية في المصارف الاسلامية، حيث تظهر تصرفات مخظغة ومتاقضة احيانا، فهنا يأتي دور الرقابة الشرعية في تمحيص وتنقيق ومتابعة العقود والوسائط المالية وتطويرها في صناعة الخدمات المفيدة، وتحذير من الوقوع في المحظور، لأن مير الرقابة الشرعية معالجة الماًخذ التي تجريها المصارف الاسلامية مواطأة، لتنقيتها من اية شوائب تخالف الشريعة إن وبدت، وسبل تصويها، وقديم التوصيات اللازمة لعلاج عللها، ولتطوير أدائها إلى الأحسن، حيث ما زالت الأنشطة المالية تلاطمها الامواج، فينبغي الاطمئنان الى الابراءات واللوائح والعقود التي نبرمها المؤسسات المصرفية، فتحتاج الى مخلصين يسيرونها الى بر الأمان، وهؤلاء هم هيئة الرقابة الشرعية. ولا ريب أن هذه الدراسة ساهمة إسهامأ متواضعا إذا قسناه بالجهد المطلوب والعمل المرقب، لدور الهية الشرعية وعملها الرئيسي في تمييز المعاملات الربوية، وتوضيح الأخطاء والتجاوزات الشرعية، وقيامها بمهامها وواجباتها لتحقيق التمية، وفقا' لأحكام الشريعة الاسلامية ومقاصدها، وتوجيه الاسشمار لصالح الفرد والمجتمع. Abstract (Arabic): لعناية ببحث الموضوعات المستجدة فيما يتعلق بالمسائل الاقتصادية, مما يساعد على تحرير هذه المسائل ونضوجها كالأسهم والسندات الذي نحن بصددها, إذ في ذلك من الأخذ بأسباب القوة والظهور ما لا يخفى, فضرورة بذل جهود حثيثة من جانب المهتمين والمشرفين لتقريب وجهات النظر الشرعية في الوساطة المالية لاهميتها في أيِّ اقتصاد سواء كان نامياً أو متقدماً, ومن شأن المسائل الحادثة التي لم يسبق للعلماء بحث فيها أن تكون صعبة التصور, فتحتاج الى قدر أكبر من التأني والتأمل, وألا يصدر حكماً بشأنها إلا بعد أن يغلب على ظنه أنه تصورها تصوراً صحيحاً, لأن الحكم على الشيء فرع عن تصوره.
