الوصف: Les terres collectives et leur marchandisation croissante au Maroc ont notamment fait leur entrée dans le débat public en raison des mobilisations protestataires qui s’opposent aux modalités de cette commercialisation. Parmi ces mobilisations, celles portées par des femmes sont les plus visibles. Elles protestent depuis 2007 contre leur exclusion du droit de jouissance sur les terres collectives ; un droit qui leur est finalement attribué par des circulaires ministérielles émises par le ministère de l’Intérieur entre 2009 et 2012. L’article se concentre sur les référentiels utilisés, à différentes échelles, pour légitimer cette inclusion des femmes parmi les listes d’« ayants-droit ». Après avoir illustré le caractère genré de l’accès à la propriété de type collective, l’article analyse comment le ministère de l’Intérieur formule et justifie l’inclusion obligatoire des femmes parmi les bénéficiaires. À travers le cas de la collectivité des Mehdawa, l’article montre, enfin, comment les délégués de cette collectivité légitiment l’application de la nouvelle directive ministérielle au niveau local en réadaptant les arguments mis en avant par l’État.
The recent emergence in Morocco’s public debate of collective lands and their increased commodification is partly due to the protest actions that are led against the ways this commercialisation is taking place. The actions carried out by women have become the most visible ones today. Since 2007, they have been protesting against their exclusion from the right to use collective lands. This right was eventually given to them via a series of ministerial circulars that were issued by the ministry between 2009 and 2012. The article focuses on the legal and normative references used, at different scales, to legitimize the inclusion of women amongst the lists of those entitled to benefit from collective land. After a presentation of the gendered character of the regime regulating collective land, the article analyses how the ministry of the Interior justifies the obligatory inclusion of women within the lists of beneficiaries. Through the case of the Mehdawa community, it finally illustrates how the delegates of this community are legitimizing the implementation of the new ministerial directives at the local level by re-adapting the arguments put forward by the State.
إن وجود الأراضي المشتركة في المغرب ومن ثم طرح هذه الأراضي في السوق، دخل ضمن نطاق الجدل العام وذلك بسبب التحركات الاحتجاجية التي تعترض على أشكال هذا التسويق. من بين هذه التحركات هناك تلك التي تقودها النساء وهي المعروفة أكثر من بين هذه التحركات. تحتج هذه النساء منذ عام 2007 ضد منعهن من التمتع بحق الانتفاع بالأراضي المشتركة، هذا الحق اللواتي انتهين بالحصول عليه من خلال قرارات من وزارة الداخلية بين عامي 2009 و 2012 . هذا المقال يركز على المرجعيات المستخدمة وعلى مستويات مختلفة وذلك لقوننة إدخال أولئك النساء ضمن قائمة " أصحاب الحق". وبعد أن نُظهر أن إمكانية التملك في الأراضي المشتركة مرتبطة بمسألة النوع، فإن المقال يحلل كيف أن وزارة الداخلية تصوغ وتبرر الإدخال الإجباري للنساء بين المنتفعين. ومن خلال حالة تعاونية المهداوية يظهر المقال كيف أن مندوبي هذه التعاونية يبررون تطبيق القرار الوزاري الجديد على المستوى المحلي عن طريق استخدام الحجج التي تستخدمها الدولة. -
