| Abstract (English): |
Ijtihad research in money issues aims to indicate the urgent need for Fiqh to go beyond the case of Fiqh reality Almabani(texl) to the Fiqh of Tanzil ) that the legitimacy) assignments require compliance and representation, and this means the link and interdependence between the Fiqh of the text (terms) and Fiqh reality, and this statement required methodology DESCRIPTION AND ther for ANALYSIS Whe fundamentalist rules or applied models, its structural course was of three subjects. The first topic included: Indication of the meaning of the terms ijtihad and money, the legitimacy of ijtihad and its vitality, '? and to whom the right of ijtihad and the role of ijtihad in society policy. The second topic: It talked about the significance of the terms policy. The second topic: It talked about the significance of the terms Fiqh and text, fixed and variable in them, and the limits of Ijtihad in the Fiqh of the text, either in the tongue the text, of the text or in the intent of and the importance of purposes in the text process, and the mechanism of conducting Fiqh text in contemporary money transactions. The third topic: It was in Ijtihad in the Fiqh of Tanzil applied models of financial) dicatc transactions), and began to in the significance of the term Fiqh of Tanzil, and its rules, and then was the application and creation of this Fiqh through the sale model of loyalty and network marketing. The research concluded to a set of results were: the all individual importance of Ijtihad in and collective transactions, and that jurisprudence policy for the theoretical texts meanings and their semantic implications, and that jurisprudence begins with linguistic and then explanatory and existential, iligence and that the safest ways of d is collective ijtihad, and that the sale of loyalty sale different In the adaptation and truth among the jurists, the network marketing sale belongs to gambling and the facilitator forbidden. يهدف بحث الاجتهاد في قضايا المال ولى بيان الحاجة الملحة للغقه لتجالآحالة فقه المباني( النص) ولى فقه الواقع(اقزيل)؛ كون التكليفات الشرعية تستدعي الامتثال والتمثل. وهذا يعني صلة التواصل والتكافل بين فقه النص الألفاظ وفقه التنزيل الواقع. واقتضى هذا البيان منهجية الوصف والتحليل سواء للقواعد الأصولية أو النمانج التطبيقية، وكان ساره الهيكلي من ثلاثة مباحث، تضمن المبحث الأول بيان دلالة محعطلحي الاجتهاد والمال، ومشروعية الاجتهاد وحيويته ، ولمن أحقية الاجتهاد؟ ودور الاجتهاد في سياسة المجتمع. اًما المبحث الثاني ذ فدار الحديث فيه عن دلالة ممعطلحي الفقه والنص، والثابت والمتفيرفيهما، وحدود الاجتهاد في فقه النص سواء في لسان النص اًو في قصد النص، وأهمية المقاصد في عملية النص، وآلية إجراء فقه النص في معاملات المال المعاصرة . اًما المبحث الثالث: فكان في الاجتهاد في فقه التنزيل( نمانج تطبيقية من المعاملات المالية) ، ويدأ ببيان دلالة مصطلح فقه التنزيل، وقواعده ثم جرى التطبيق والتخلق لهذا الفقه من خلال نمونج بيع الوفاء والتسويق الشبكي، وخلص البحث إلى مجموعة من النتائج تمثلت في أهمية الاجتهاد في كافة المعاملات الفردية والجماعية، وأن الفقه سياسة لمعاني النصوصى النظرية ودلالاتها التنزيلية، وأن الفقه يبداً بالمدرك اللغوي ثم التعليلي ثم الوجودي، كما أن أسلم طرق الاجتهاد هو الاجتهاد الجماعي، و1ن بيع الوفاء بيع مختلف في تكييفه وحقيقته بين الفقهاء، اًما التسويق الشبكي فبيع ينتمي إلى القمار والميسرالمح.
