| Abstract (English): |
This study aims to examine and authenticate Najm Addeen Al-Zuhairi's book '41 Issues of Invalidated Judicial Sentences' covering issues pertaining to invalidating judicial sentences. The study consists of an introduction and two sections. The introduction outlines the topic significance, rationale and methodology. The first section included two sub-sections: the first subsection deals with the author while the second sub-section discusses the workbook. The second section focuses on investigating and authenticating text message. The study adopted an investigation method based on tracing the message back to the original sources, making reference to notable proponents and books, commenting on some linguistically unfamiliar words and clarifying meanings and intentions in context. The study concluded with confirming the authenticity of the writer identification of the book, and the topic it covers in Hanafi jurisprudence, which included forty-one issues. The author divided the issues into three sections: the first: is on agreed upon issues (thirty issues), the second: what they differed about (six issues), and the third: what the imam did not have to say and the companions disagreed about (five issues). هدف هذا البحث إلى تحقيق رسالة (المسائل التي يُنقض فيها الحكم إذا وقع من حاكم) لنجم الدين محمد الزهيري الحنفي، التي تشتمل على مسائل عدَّة يُنقض فيها الحكم إذا وقع من حاكم، وقد جاء في مقدمة وقسمين وفهارس. اشتملت المقدمة على أهمية الموضوع وأسباب اختياره وخطة البحث. واشتمل القسم الأول على مبحثين؛ الأول في دراسة المصنف، والثاني في دراسة الكتاب. كما اشتمل القسم الثاني على إخراج نص الرسالة وتحقيقها. وتمثل المنهج الذي سرت عليه في دراسة المخطوط، فيما يلي: عزوت إلى المصادر الأصلية التي ينقل عنها المصنف متى أمكن الوقوف عليها. التعريف بالأعلام والكتب التي وردت في الرسالة. التعليق على بعض الكلمات الغريبة لغويًا، والإشارة إلى معانيها، أو المقصود منها في سياقها. قمت بإيضاح بعض غوامض الجمل. وضعت تعليقات يسيرة على كلام المصنف في بعض المواطن. ومن أهم نتائج هذا البحث: صحة نسبة الرسالة إلى مؤلفها، وموضوع الرسالة في الفقه الحنفي، تضمنت إحدى وأربعين مسألة. قسم المصنف المسائل إلى ثلاثة أقسام: الأول: ما اتفق عليه الأصحاب (وذكر فيه ثلاثين مسألة)، والثاني: ما اختلفوا فيه (وذكر فيه ست مسائل)، والثالث: ما لا نص فيه عن الإمام واختلف الأصحاب فيه (وذكر فيه خمس مسائل)، وأن الأحكام القضائية إذا وقعت على خلاف النص والإجماع تُنقض.
