| Abstract (English): |
This study aims to elucidate Imam Al-Bukhari’s jurisprudential approach and identify his rulings on various Islamic jurisprudential issues. The inductive, analytical, and comparative methodology was employed. The study comprises thirteen chapters of Imam Al-Bukhari's authentic Hadith book including the chapter on "Statement of a person: such and such," highlighting his juristic methodology in terms of narrations related to a person's statement, his rulings on Jurisprudential issues in light of other texts, the opinions of jurists and hadith scholars regarding the matter, and the instances where Imam Al-Bukhari deviates from his usual approach of aligning with the statements of the Prophet Mohammad (peace be upon him) to focus on the statement of a person. The findings showed that Imam Al-Bukhari was a leading Hadith scholars who formulated jurisprudential rulings based on textual evidence, supported through narration. Additionally, Al-Bukhari's juristic opinions were deep as reflected in his creative biographical approach, avoiding blind imitation of others. The way Al-Bukhari’s explanations have been utilized by commentators was emphasized, indicating the significant impact of his statements and biographies on commentators’ views. يهدف البحث إلى إيضاح منهج الإمام البخاري الفقهي، ومعرفة الوصول إلى ما قرره من مسائل فقهية، وقد استعمل البحث المنهج الاستقرائي التحليلي والمقارن، وتناول البحث ثلاثة عشر بابا من الأبواب التي قال فيها الإمام البخاري: باب قول الرجل كذا وكذا ، وقد تبين من خلال دراسة تلك الأبواب منهج الإمام البخاري الفقهي من الترجمة بقوله: باب قول الرجل كذا وكذا، معرفة ما قرره الإمام البخاري من مسائل فقهية من خلال التبويب بقوله: باب قول الرجل كذا وكذا، في ضوء النصوص الأخرى، وما يذهب إليه الفقهاء والمحدثون حول المسألة، وبيان وجه عدول الإمام البخاري عن قوله: باب قول النبي ﷺ كذا وكذا إلى قوله: باب قول الرجل كذا وكذا ، كما تبين من البحث أن الإمام البخاري من أئمة الأثر، الذين يذهبون في الأحكام الفقهية من خلال اعتماد النص والقول به، كما أبرز البحث تعمق الإمام البخاري في آرائه الفقهية من خلال تراجمه بطريقة إبداعية بين خلالها عدم تقليده لأحد، وأن الشراح قد استفادوا من قول البخاري، وتراجمه لأبواب كتابه، وهذا يتضح من خلال المقارنة بين أقوالهم.
