The claimant requested non-pecuniary damage for the non-pecuniary damage suffered as a result of the sanctioning decision. The court analyzed this damage only from the perspective of issuing the sanctioning decision and not in the light of the factual situation existing at the workplace prior to this decision. However, by the grounds of appeal, the claimant invoked other aspects than those invoked at first instance, new reasons that could not be analyzed considering the provisions of Article 478 Code of Civil Procedure [ABSTRACT FROM AUTHOR] |

Reclamanta a solicitat daune morale pentru prejudiciul moral suferit produs prin emiterea deciziei de sancţionare. Instanţa a analizat acest prejudiciu doar din perspectiva emiterii deciziei de sancţionare şi nu prin prisma situaţiei de fapt existente la locul de muncă anterior acestei decizii. Însă, prin motivele de apel, reclamanta a invocat alte aspecte faţă de cele invocate la prima instanţă, motive noi ce nu au putut fi analizate având în vedere dispoziţiile art. 478 C. pr. civ.
