Preliminary Injunctions Against Content on the Internet - Legal and Technical Analysis of the New Swiss Rules of Civil Procedure (Einstweiliger Rechtsschutz Gegen Internetinhalte Nach Schweizerischer Zivilprozessordnung - Rechtliche und Technische Aspekte)
This article discusses cases in which interim injunctions are permissible against content on the internet. Interim injunctions are especially useful against internet content as long as the content has not been published yet. After publishment of the content on the internet, it becomes much harder to fight internet content because it is generally spoken very difficult to erase content from the internet. Therefore, it is essential to prevent the publishment of content with interim legal means. But this can only happen if the freedom of speech is being respected. This article analyzes the requirements according to the new Swiss Code of Civil Procedure, which has become effective on January 1, 2011.
