Spanish Abstract: Mediante un trabajo de corte dogmático, y la aplicación del método exegéticocrítico, el presente artículo analiza si la aplicación sistemática, no solicitada y excesiva del telemercadeo y el mailing digital, efectuada con el objeto de obtener una rápida decisión de compra del consumidor, y generalmente materializada a través de instrumentos contractuales preelaborados y a distancia, puede conducir al posible cometimiento del acto de competencia desleal de acoso e influencia indebida contra el consumidor, el cual, al infringir el marco jurídico vigente en Ecuador, puede ser procesado y sancionado, tanto en sede administrativa como jurisdiccional |

English Abstract: Through a dogmatic work, and the application of the exegetical-critical method, this article analyzes whether, the systematic, unsolicited and excessive application of telemarketing and digital mailing, carried out in order to obtain a quick purchase decision by of the consumer, and which generally materializes through preprepared and remote contractual instruments, leads to the possible commission of the act of unfair competition of harassment and undue influence against the consumer, which by violating the legal framework in force in Ecuador, is feasible to be sanctioned, both in administrative and jurisdictional levels |
