Among the arrangements that the Turkish arbitration legislation inspired includes the arbitration provisions of German law. Moreover, both Turkey and Germany drafted their international arbitration codes in accordance with the UNCITRAL Model Law. In addition, the German Federal Court’s judgment played a prominent role in Turkish literature and practice. Because of these reasons, in this study, the decisions of the German Federal Court made in 2019 regarding arbitration are translated from German into Turkish and summarized. [ABSTRACT FROM AUTHOR] |

Tahkime ilişkin mevzuatının oluşumunda esinlenilen düzenlemeler arasında Alman hukukunun tahkime ilişkin hükümleri de yer almaktadır. Ayrıca hem Türkiye hem de Almanya, milletlerarası tahkime ilişkin düzenlemelerinde UNCITRAL Model Kanunu’nu esas almıştır. Üstelik Türk literatüründe ve uygulamasında Alman Federal Mahkemesi kararlarının önemli bir yeri vardır. Bu öneminden dolayı çalışmamızda Alman Federal Mahkemesi’nin tahkimle ilgili olarak 2019 yılında vermiş olduğu kararların tamamı Almancadan Türkçeye çevrilerek özetlenmiştir. [ABSTRACT FROM AUTHOR] |
