| Abstract (English): |
The conclusion is that the freedom to exercise navigation is clearly and clearly in the area of the high seas, which is not under the sovereignty of any State, and has been stipulated by international conventions, and therefore has become a rule established within the principle of the freedom of the high seas, but for the exercise of this freedom there are conditions and rules. States must abide by them in exercising this freedom, there are conditions for the ship to be built and equipped for the purpose of sailing and to use all means of safety in order to preserve the lives of its passengers, crew and commercial cargo, in order to carry out this activity, in addition to the availability of conditions for the ship's crew in terms of number, scientific competence and experience of the ship's captain so that the ship can safely arrive from the port of departure to the port of arrival. الاستنتاج هو أن حرية ممارسة الملاحة واضحة و بوضوح في منطقة أعالي البحار التي لا تخضع لسيادة أي دولة ، وما نصت عليه الاتفاقيات الدولية ، و لذلك أصبح قاعدة تم تأسيسها ضمن مبدأ الحرية في أعالي البحار ، ولكن لممارسة هذه الحرية هناك الشروط والقواعد. يجب على الدول الالتزام بها في ممارسة ذلك الحرية ، هناك شروط لبناء السفينة وتجهيزها الغرض من الإبحار واستخدام كافة وسائل الأمان حفاظًا على أرواح ركابها وطاقمها وحمولتها التجارية ، من أجل القيام بها هذا النشاط بالإضافة إلى توافر الشروط للسفن الطاقم من حيث العدد والكفاءة العلمية والخبرة قبطان السفينة حتى تتمكن السفينة من الوصول بأمان من ميناء المغادرة إلى ميناء الوصول.
