| Abstract (English): |
This research examines the rule of virtue related to the worship first of related to its place or time; whereas the researcher examined the extended concept of the virtue meaning that is a synonym for recommended deed, Sunnah, recommendable, and what is not deemed a pillar or requirement. This research plan includes an introduction, two topics, and a conclusion that includes the most significant results as follows: the origin requires to do worship including virtues and integrity, but if the man cannot combine between the same cult and what is related to its place, he shall consider to give priority to the essence of the worship, for example, if the injector fears to miss Salah al Jama'ah if he reperform ablution at the beginning of the prayer time, then the priority shall be given to Salah al Jama'ah and eliminate supervening event. It is an exception to the general rule that there is a text determined the excluded one from the standard rule or the existence of an interest or need prevented to include the excluded question to the standard rule [ABSTRACT FROM AUTHOR] |

يتناول هذا البحث قاعدة الفضيلة المتعلقة بنفس العبادة أولى من المتعلقة بمكانها أو زمانها حيث يتناول البحث معنى الفضيلة بمفهومها الواسع لا شرط.ويشتمل البحث على مقدمة ومبحثين وخاتمة تتضمن أهم النتائجادف المندوب والسنة والمستحب وما ليس بركن والذي ير، ومنها : أن اء الجمع بين ذات العبادة وبين ما يتعلق بمكانها فيرالأصل تأدية العبادة بما تشتمل عليه من الفضائل والكمال لكن إذا لم يستطع المرعى في التقديم ما له علاقة بذات العبادة، ومن أمثلة ذلك :إذا خاف الحاقن من فوات صلاة الجماعة لو أعاد الوضوء أو فوات فضيلة أول الوقت الة العارض.ويستثنى من القاعدة وجود نص خصص المستثنى من حكم القاعدة أو وجود مصلحة أو حاجة منعت منفالأولى ترك الجماعة وإز إلحاق المسألة المستثناة بالقاعدة.
