| Abstract (English): |
The study dealt with the issue of unfairness in sales, by relying on the inductive approach to track the sayings of scholars in the field, then analyze them, compare them, and clarify the most correct ones. The study concluded that gross injustice requires the option for the aggrieved to pay the damage for it, and there is no time limit for the option, but it is due to the agreement of the contracting parties, and the reference the in the event of disagreement, in order to ward off harm and protect people’s rights. تناولت الد ا رسة مسألة الغبن في البيوع، وذلك من خلال الاعتماد على المنهج الاستق ا رئي لتتبع أقوال العلماء في ثم تحليلها، ومقارنتها، وبيان ال ا رجح منها، وقد تناول البحث مفهوم الغبن في البيوع، وأنواعه المعتبرة عند الفقهاء، مع بيان آثار كل نوع، وضابط الغبن المؤثر في البيع، وقد توصلت الد ا رسة إلى نتائج، أهمها: أن الغبن الفاحش يوجب الخيار للمغبون لدفع الضرر عنه، ولا حد زمني للخيار، وإنما يرجع فيه إلى اتفاق المتعاقدين، والمرجع إلى الع رف والعادة في حال عدم الاتفاق، دفعاً للضرر، وحماية لحقوق الناس.
