This research aims to clarify how the term “al-Bayan bi al-Naṣbah” and its formation appeared in Imam Al-Jassas, and analyze true understandıng of the term “al-Bayan bi al-Nisbah” (viz. not al-Naṣbah) mentioned in the two critical edition of “Al-Fuṣūl fi al- `Uṣūl”. On this account, the present paper elucidates on how the term 'Bayan' exceeds the meaning of expressing the meaning of the word, reaching out another broader meaning that includes the relationship between the signifier and the signified. In addition, Al-Jahiz’s approach to the term “al-Bayan bi al-Naṣbah” is studied, for he was the first to put it into a term for the rhetoricians in his book “Al-Bayan wa Al-Tabeen”. Finally, this paper scrutinizes the meaning of “al-Bayan bi al-Naṣbah” given by Imam Al-Jassas and how he adopted this term from the perspective of Al-Jahiz on the principles of jurisprudence. يهدف هذا البحث إلى بيان كيفية ظهور مصطلح "البيان بالنصبة" عند الإمام الجصاص وتشكله، ودلالات استخدام الإمام له والأصل الذي استقى منه هذا المصطلح قبل توظيفه بمعنى خاص في أصول الفقه، ويوازي هذا الهدف آخر يسعى إلى تحليل حقيقة مصطلح "البيان بالنسبة" الذي ورد في تحقيقيّ "الفصول في الأصول"، محاولا كشف اللبس الذي وقع فيه محققو الفصول عند كتابتهم لهذا المصطلح، وصولا لنتيجة مفادها أن ما قصده الجصاص هو "النصبة"، وليس "النسبة" التي أوردها المحققون. وانطلاقاً من ذلك فقد تم خلال هذا البحث محاولة توضيح كيف تجاوز مصطلح البيان معنى التعبير عن المعنى باللفظ، ليصل إلى معنى آخر أوسع يشمل علاقة الدال والمدلول، وقد كان هذا التوضيح عند البلاغيين يهدف بالأساس إلى تعريف مصطلح البيان عند الأصوليين. وقد تم إلى جانب ذلك توضيح موقف الجاحظ من مصطلح "البيان بالنصبة" كونه أول من وضعه مصطلحا عند البلاغيين في كتابه "البيان والتبيين". وقد تم أخيرا في هذا البحث معالجة معنى "البيان بالنصبة" عند الإمام الجصاص وكيف أسقطه من منظور الجاحظ على أصول الفقه. إلى جانب العمل على حلّ مشكلة ما ورد في نسَخ "الفصول في الأصول" بـ"البيان بالنسبة" من خلال إظهار أن أصل المصطلح هو "البيان بالنصبة" كما هو أصله عند الجاحظ. وظهر بنا في هذا البحث أن الإمام الجصاص قد استعار مصطلح "البيان بالنصبة" من أهل البلاغة والكلام، فأدعوا طلبة العلم لفهم ما عنى الأصوليون في كتبهم الأصولية دراسة أصول الفقه على ضوء علاقته بغيره من التخصصات.
