| Abstract (English): |
This is an inductive and applied research related to the issue of the change in Shari’ah rulings from a Maqasid perspective, The concept of "changing the rulings" becomes clear. It reveals the features of rulnings which accept change and determine their domains and fields through observing and studying a multitude of Maqasid bases. They are selected from various aspects of the science of Maqasid, which have their own effects in determining the requirements, paths, and regulations of “the change of ruligs” in a manner consistent with the actions and aims of the Legislator. هذا بحث استق ا رئي تأصيلي تطبيقي، له صلة بمسألة تغيُّر الأحكام الشرعية من منظور مقاصدي، يتضح فيه مفهوم " تغيُّر الأحكام"، ويكشف عن سمات الأحكام التي تقبل التغيُّر، وتتحدد ميادينها ومجالاتها، وذلك من خلال رصد ود ا رسة عدد من قواعد مقاصد الشريعة، التي انتخبت من جوانب متعددة من علم المقاصد، ولها أثرها في تعيين موجبات ومسالك وضوابط تغيُّر الأحكام، بما يتلائم مع تصرفات الشارع وغاياته من تشريع الأحكام.
