| Abstract (English): |
[Purpose] To analyze and determine the impact of telematic media on the exercise of the communication regime between children and adolescents and their parents, with emphasis on the transformation generated by the mobility restrictions derived from Covid-19. [Methodology/Approach/Design] For the development of this work, a descriptive and explanatory research is used, employing the dogmatic methodology -classical of the legal sciences- and the systematic, analytical and factual sub-methods. [Findings] Based on the present work, it is evident that: (i) effective compliance with the communicational regime cannot be understood exclusively from a physical visitation mechanism; (ii) telematics resources have allowed the communicational regime through physical visits to be complemented as well as perfected; (iii) there is a normative diaspora at the international level - with greater force after the pandemic - that tries to regulate virtual interaction in the compliance of communicational regimes, however it is not possible to define a majority position that resolves its treatment, although physical contact is still considered as a necessary source to guarantee the family unity of the child and adolescent. [Practical Implications] This article critically emphasizes two points: (i) the normative dispersion with respect to the regulation of telematics media as formulas for compliance of the communication regime; consequently, (ii) it is necessary to carry out an interdisciplinary analysis to determine to what degree the new technologies allow the generation of the affective bond required by the communication regime, and to which children and adolescents and their parents have a right. [Originality/Value] The present research is novel given the post-pandemic context in which the need to incorporate telematic media in the communication regime must be verified, as well as the opportunity to anticipate future scenarios that may again generate isolation measures. [Propósito] Analizar y determinar cuál es el impacto de los medios telemáticos en el ejercicio del régimen comunicacional entre niños, niñas y adolescentes y sus progenitores, haciendo hincapié en la transformación generada por las restricciones de movilidad derivadas del Covid-19. [Metodología/Enfoque/Diseño] Para el desarrollo de este trabajo se hace uso de una investigación descriptiva y explicativa, empléandose la metodología dogmática --clásica de las ciencias jurídicas-- y los submétodos sistemático, analítico y de enjuiciamiento de hecho. [Resultados] A partir del presente trabajo se evidencia que: (i) el efectivo cumplimiento del régimen comunicacional no puede entenderse exclusivamente a partir de un mecanismo de visitas físico; (ii) los medios telemáticos han permitido que el régimen comunicacional mediante visitas físico, tanto se complemente como se perfeccione; (iii) existe una diáspora normativa a nivel internacional -con mayor fuerza, posterior a la pandemia- que trata de regular la interacción virtual en el cumplimiento de los regímenes comunicacionales, no obstante no se puede definir una postura mayoritaria que resuelva su tratamiento, aunque se sigue catalogando el contacto físico como una fuente necesaria para garantizar la unidad familiar del niño, niña y adolescente. [Implicaciones Prácticas] El presente artículo hace énfasis crítico en dos puntos: (i) la dispersión normativa frente a la regulación de los medios telemáticos como fórmulas de cumplimiento del régimen comunicacional; en consecuencia, (ii) se hace necesario realizar un análisis interdisciplinario que determine en qué grado las nuevas tecnologías permiten generar el vínculo afectivo que exige el régimen comunicacional, y a la que tienen derecho los niños, niñas y adolescentes y sus progenitores. [Originalidad] La presente investigación es novedosa dado el contexto post-pandemia en el que debe verificarse la necesidad de incorporar los medios telemáticos en el régimen comunicacional, así como también la oportunidad de anticipar futuros escenarios que puedan nuevamente generar medidas de aislamiento.
