| Abstract (English): |
This research aims to clarify the relationship of the supererogatory with the obligatory acts and their importance, and to identify some of the fundamental rules affecting the supererogatory acts. It was divided into an introduction and three sections. The first section dealt with the definition of fundamental rules. The second section dealt with the definition of the supererogatory and the statement of the insight of its legitimacy and its equivalent terminology. The third section was concerned with the fundamental rules related to the supererogatory and their jurisprudential applications. The research concluded that the term "nafl" in jurisprudence is applied to several jurisprudential sections. Some supererogatory rules are common to jurisprudence and fundamental rules. Among the fundamental rules related to the supererogatory prayers are those that are agreed upon among scholars, and some of them differ. The broad use of the term nawāfil is sometimes equated with mandūb, mustahab, and tatawa, but nawāfil is most commonly used for its comprehensiveness. [ABSTRACT FROM AUTHOR] |

يهدف هذا البحث إلى بيان علاقة النوافل بالفرائض وأهميتها، والوقوف على بعض القواعد الأصولية المؤثرة في أفعال النوافل، وعلى جهود العلماء في استنباط الأحكام من الأدلة وطرق الترجيح عند الاختلاف بينهم، والوقوف على أسباب اختلاف الفقهاء في القواعد الأصولية وأثره في اختلاف الفروع الفقهية، وكذا على بعض القواعد الأصولية المتعلقة بالنوافل. وتم تقسيمه إلى مقدمة وثلاثة مباحث، تناول المبحث الأول: تعريف القواعد الأصولية، وتطرق المبحث الثاني إلى تعريف النوافل وبيان حكمة مشروعيتها والمصطلحات المرادفة لها، واهتم المبحث الثالث بالقواعد الأصولية المتعلقة بالنوافل وتطبيقاتها الفقهية، وخلص إلى أن مصطلح النفل في الفقه يطلق على عدة أبواب فقهية. بعض قواعد النوافل مشتركة بين القواعد الفقهية والقواعد الأصولية. ومن القواعد الأصولية المتعلقة بالنوافل ما هو متفق عليه بين العلماء ومنها ما هو مختلف فيه. وللنوافل ألفاظ مترادفة كالمندوب والمستحب والتطوع، لكن النوافل أكثر استعمالا لشمولها، فكل فعل من الأفعال المفروضة فيه ما هو مندوب أو مستحب أو ما ليس واجبا.
