| Abstract (English): |
The prohibition imposed by Article 561 of Law no. 350/2001 regarding the arrangement of the territory and urbanism refers strictly to the situation in which the initiation and approval of town planning documents aim at the entry into legality of some constructions built without building permit or which do not comply with the building permit and such sanction is applicable precisely to prevent the circumvention of legal provisions by subsequently covering irregularities through a so-called entry into legality, but the claimant is not in such a situation as long as the PUZ was not drawn up upon its request, in order to enter into legality, but upon the request of other persons, and the approved amendments cover the entire area, which includes the land owned by the claimant. Interdicţia impusă de art. 561 din Legea nr. 350/2001 privind amenajarea teritoriului şi urbanismului se referă strict la situaţia în care iniţierea şi aprobarea documentaţiilor de urbanism au ca scop intrarea în legalitate a unor construcţii edificate fără autorizaţie de construire sau care nu respectă prevederile autorizaţiei de construire, o astfel de sancţiune intervenind tocmai pentru a se preîntâmpina eludarea dispoziţiilor legale prin acoperirea ulterioară a neregulilor printr-o aşa-zisă intrare în legalitate, însă reclamantul nu se află într-o astfel de situaţie câtă vreme elaborarea PUZ-ului nu s-a făcut la solicitarea sa, în scopul de a se intra în legalitate, ci la solicitarea altor persoane, iar modificările aprobate vizează întreaga zonă, în care este inclus şi terenul deţinut de reclamant.
