| الوصف: | Sanayi ve teknolojinin hızlı gelişimi sosyal, kültürel ve ekonomik alanda büyük değişimlere sebep olmuştur. Üretim anlayışı yerini tüketime bırakınca ticari firmalar tüketim hızına erişmek için yeni arayışlara yönelmiştir. Firmalar rekabet gücünü artırmak, talebe cevap verebilmek ve maliyeti düşürmek gibi nedenlerle dış kaynak teminine gitmek zorunda kalmışlardır. İktisadi alandaki bu gelişmelerin İslâm hukukuna uygunluğunu belirlemek ve bu hususta müteşebbislere rehberlik etme gereksinimi artmıştır. Konunun ilk dönem kaynaklarda, haram faaliyette bulunacak kişi veya firmalara hammadde temini özelinde akitlerde zâhirî irade beyanının yanı sıra maksatlara da itibar edilip edilmeyeceği kapsamında değerlendirildiği görülmüştür. Bu araştırmada klasik kaynaklardaki yaklaşımdan hareketle kötülüğe vesile olma maksadı sebebiyle sedd-i zeria ilkesi bağlamında konunun değerlendirmesi amaçlanmıştır. Buna göre; outsourcing uygulamalarının fıkhî değerlendirmesinde; işletmenin faaliyet alanı, dış kaynak temininin hangi konuda sağlanacağı, firmaya temin edilen dış kaynağın haram faaliyette kullanılıp kullanılmayacağı ve verilecek desteğin işletmenin ana faaliyet alanının bir halkasını oluşturup oluşturmadığının tespiti belirleyici olacaktır. The rapid development of industry and technology has caused great changes in social, cultural and economic areas. Production concept has been replaced by consumption. The rate of consumption of societies has pushed new searches. Companies have had to go to outsourcing for reasons such as increasing their competitiveness, responding to demand and reducing costs. It is necessary to determine the compliance of these developments in the economic field with Islamic law and to guide the entrepreneurs.
