Розглянуто деякі питання проведення негласних слідчих (розшукових) дій, зокрема, вплив активних та ініціативних провокаційних дій, допущених під час контролю за вчиненням злочину з боку уповноважених осіб компетентних державних органів, на допустимість фактичних даних, отриманих в результаті його проведення як доказів у даному кримінальному провадженні, та їх наслідки у вигляді істотного обмеження та порушення прав і основоположних свобод людини і громадянина, гарантованих Європейською конвенцією про захист прав людини і основоположних свобод. Особливу увагу приділено прецедентній практиці Європейського суду з прав людини у справах про провокації з боку працівників правоохоронних органів, зокрема, слідчих та співробітників оперативних підрозділів. Рассмотрены отдельные вопросы проведения негласных следственных (розыскных) действий и, в частности, влияние активных и инициативных провокационных действий, допущенных во время контроля за совершением преступления со стороны уполномоченных лиц компетентных государственных органов, на допустимость фактических данных, полученных в результате его проведения как доказательств в данном уголовном производстве, и их последствия в виде существенного ограничения и нарушения прав и основных свобод человека и гражданина, гарантированных Европейской конвенцией о защите прав человека и основных свобод. Особое внимание уделено прецедентной практике Европейского суда по правам человека в делах о провокации со стороны работников правоохранительных органов и, в частности, следователей и сотрудников оперативных подразделений. Main legal issues concerning the order, procedural and factual grounds for the conduction of covert investigative actions have been reviewed in the article, some problematic aspects of legislation and practice concerning conduction of such actions and their significance and consequences for criminal proceedings have been selected and described. A number of problems that are related to the significant restrictions of such rights and fundamental freedoms of individuals and citizens as the right to protection, the right to a fair trial have been identified. Such problems are connected with provocation of committing a crime by law enforcement bodies, that leads to recognition of evidence inadmissible and, as a result, impossibility to achieve the tasks of criminal proceedings. The author also has examined and analyzed the practice of the European Court of Human Rights and the practice of national courts concerning the legality of conducting separate covert investigative actions, use of their results, assessment of evidence obtained as a result of conducting separate covert investigative actions from the position of admissibility. Especial purpose of the research is a determination of ways to overcome the explored problems and making suggestions on this issue. Particular attention is paid to the practice of the European Court of Human Rights precisely in the context of the protection of human rights from violations in the process and as a result of some covert actions concerning it. Situations in which during the conduct of the secret actions may be violated the fundamental rights guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms have been considered and covered, in particular, the right to a fair trial, the right to respect for honor and dignity, the right to protection. The author defined the negative consequences of the problem and proposed ways of its solution.
