| الوصف: | In this study, it is aimed to reveal the ways in which the experts make sense of the custody evaluation process in the process of deciding custody of children. The study is based on the basic interpretive design, one of the qualitative research methods. The study group consisted of five experts who prepared a custody evaluation report and were selected by the snowball sampling method. In the study, which used the interview technique, ‘Interview Form’ was used as the data collection tool. As a result of the study, there are differences in the preparation of custody reports within the judicial system; the manner in which experts work, the number of experts writing the report, the availability of ancillary resources in the evaluation process, and the manner in which the report is prepared vary from court to court; the findings of this change rather than individual differences are the results of the court judge's point of view. In addition, it was concluded that the decision about custody was only the opinion of the experts and that the judges had the authority to say the last word. Although the experts claim that they care about the child's development and the right to participate in the decision making process, there is no evidence that the developmental evaluation of the child and the way that the child's developmental characteristics affect opinion are included. The child's right to participate also affects the decision only in interviews with older children. At the same time, although experts generally care about auxiliary resource data and home visits, they cannot access such information because the system is inappropriate. Bu çalışmada boşanma nedeniyle parçalanan ailelerde çocukların velayetine karar verme sürecinde aile mahkemelerinde görevli uzmanların velayete ilişkin değerlendirme sürecini anlamlandırma biçimlerini ortaya koymak amaçlamaktadır. Çalışma nitel araştırma yöntemlerinden temel yorumlayıcı desen üzerine kurgulanmıştır. Çalışma grubunu velayete ilişkin değerlendirme raporu hazırlayan ve kartopu örnekleme metodu ile seçilen beş uzman oluşturmuştur. Görüşme tekniğinin kullanıldığı çalışmada, veri toplama aracı olarak ‘Görüşme Formu’ kullanılmıştır. Çalışma sonucunda adliye sistemi içerisinde velayet raporlarının hazırlanmasına ilişkin farklılıkların olduğu, uzmanların çalışma şekillerinin, raporu yazan uzman sayısının, değerlendirme sürecinde yardımcı kaynaklardan faydalanma durumlarının ve raporu hazırlama biçimlerinin mahkemeden mahkemeye değiştiği, bu değişikliğe bireysel farklılıkların yanında mahkeme hâkiminin bakış açısının neden olduğu bulguları elde edilen sonuçlar arasındadır. Bunun yanı sıra velayete ilişkin kararda uzmanların yalnızca kanaat bildirdikleri, son sözü söyleme yetkisinin hâkimlerde olduğu sonucuna ulaşılmıştır. Uzmanlar her ne kadar çocuğun gelişimini ve çocuğun katılım hakkını velayete ilişkin karar verme sürecinde önemsediklerini iddia etseler de çocuğun gelişimsel değerlendirmesine ve çocuğun gelişimsel özelliklerinin kanaati etkileme biçimine yer verilen bir bulguya rastlanmamıştır. Çocuğun katılım hakkı da bu bağlamda yalnızca büyük yaş grubu çocuklarla yapılan görüşmelerde karara etki etmektedir. Aynı zamanda uzmanlar yardımcı kaynak verilerini ve ev ziyaretlerini genel olarak önemsiyor olsalar da sistemin uygun olmaması nedeniyle bu tarz bilgilere ulaşamamaktadır. |
