| الوصف: | Le droit écossais, dit mixte romano-civiliste, procède de l’interpénétration des deux systèmes classiques : le droit romano-civiliste et la common law. Sa géohistoire présente une inversion : c'est dans la partie des îles Britanniques qui n’a pu être conquise par Rome, que, plus tard, le droit romain fut adopté. Cela a des conséquences sur l’approche juridique de la jeunesse : schématiquement, dans les systèmes d’inspiration romaine, l’acquisition de la capacité est généralement brutale. Au contraire, dans ceux relevant de la common law, elle se fait graduellement. Il peut aussi exister des paliers, on parle alors de « pré‑majorité ». La bordure méridionale de l’Écosse constitue donc, à cet égard, une discontinuité juridique. Cet article en dresse un tableau. La frontière « nationale » Écosse-Angleterre permet parfois aux jeunes gens de jouer sur les deux tableaux, induisant des stratégies d’optimisation. Scots law, described as a mixed system of civil law and Common Law, stems from the interpenetration of those two classical systems. Its geohistory proceeds from an inversion: it is in the part which couldn’t be conquered by Rome that Roman law was adopted. This had consequences on the legal approach for youth: to simplify, in Roman-inspired systems, getting legal capacity is generally a brutal phenomenon, as one gets it all at the same age. On the contrary, in Common Law, the acquisition is gradual. When it appears in stages, one speaks of “pre‑majority”. In this regard, the southern border of Scotland establishes a remarkable discontinuity, which this paper describes. The Anglo-Scottish border allows young people to receive the benefit of both English and Scottish laws, inducing optimization strategies. |
