| الوصف: | Pretende-se aqui examinar a situação penal dos membros superiores da sociedade empresária que, no contexto da atividade empresarial, emitem ordens para que um subordinado execute a ação definida como crime. Serão investigadas as posições doutrinárias existentes a respeito do tema, especialmente autoria, coautoria, autoria mediata e participação. Ao final, far-se-á uma análise da conduta a partir do Direito Positivo brasileiro, estabelecendo uma proposta de solução para a determinação da coautoria do superior empresarial emissor da ordem. The intention here is to examine the criminal situation of the upper members of the entrepreneurial organization which, in the context of business activity, issues orders to a subordinated execute the action defined as crime. Will be investigated doctrinal positions about the theme, especially, authorship, co-authorship, mediated authorship and participation. At the end will be conducted an analysis of the conduct from the brazilian law, establishing a solution proposal to determine the (co)authorship of the order issuer. |
