| الوصف: | Çalışma hayatında hukuk kurallarının uygulanması ancak etkin bir iş denetimi ile mümkün olur. İş denetimi çalışma yaşamındaki en önemli hususlardan birisi olmasına rağmen ülkemizde yeterince önem verilmeyen bir konudur. Yapılan denetimlerin amacı sadece bir işyeri özelinde eksikliklerin giderilmesi değildir, genel olarak hukuki düzenlemelere uyulması ve alınması gereken önlemler hususunda yetkili kurum ve kuruluşların bilgilenmesi amacına da hizmet eder. Uluslararası Çalışma Örgütü’nün öncelikli olarak sınıflandırdığı ve ülkemizin taraf olduğu 81 sayılı Sanayi ve Ticarette İş Teftişi Hakkındaki Uluslararası Çalışma Sözleşmesi iş denetimine ilişkin esasları ortaya koymaktadır. Çalışmamızın odak noktasını Türk hukukunda iş denetimi ve Türkiye’nin 81 sayılı Sözleşmenin gereklerini yerine getirip getirmediği oluşturmaktadır. Uzmanlar Komitesinin son on yıl içindeki gözlem ve yorumları incelendiğinde, Türkiye’nin sözleşmenin getirdiği yükümlülüklerini yerine getirmediği noktalar belirlenecek ve etkin bir iş denetimi sisteminin ülkemizde oluşturulması için önerilere de yer verilecektir. The application of legal rules is only possible through effective labour inspection system. Although labour inspection system is one of the most important issues in working life, also it is an issue that is not given enough importance in our country. The inspections are not only to eliminate deficiencies in the workplace, but also serve the purpose of informing the competent institutions and organizations about how the legal regulations to be applied and the measures to be taken. Labour Inspection Convention No. 81 which is classified by the ILO as a priority and to which Turkey is a party, sets out the principles of labour inspection. Labour inspection in Turkish law constitutes the focal point of the research and the question will be tried to answer whether Turkey has been fulfilled the requirements of Convention No. 81 or not. When the Committee of Experts on the Application of Conventions and Recommendations observations and direct request in a ten year period show that which points Turkey’s obligations are not fulfilled. In order to have effective labour inspection system recommendations will be given when relevant. |
