| الوصف: | Despite still being the predominant theory of authorship and participation in German criminal law, an increasing number of criticisms of the theory of domination of the act can be observed. Most of the criticisms, however, refer to isolated points of its facets. In this sense, the article develops a deep and intense criticism of the theoretical foundations of this theory. It starts from the hypothesis that the theory of domination of the act has failed as a whole, and that, therefore, it is necessary to fully return to the core of the subjective theory (even if in a modified form). Parte-se da hipótese de que a teoria do domínio do fato fracassou como um todo, e que, portanto, é preciso retornar integralmente ao núcleo da teoria subjetiva (ainda que em uma forma modificada).
