| الوصف: | Cíclicamente se discute la situación de la niñez y la adolescencia en la República Argentina en cuanto objeto de las políticas sociales. El asunto aparece ligado a las problemáticas de la seguridad (personal) confundiéndose en ocasiones la frontera que divide a ésta del funcionamiento la Justicia y los instrumentos normativos. Se tiende a creer que la sanción en sí misma rehabilita, reduciendo la problemática de la intervención transformadora al denominado “garantismo penal” pero sin incluir con idéntica fuerza las garantías substanciales con rango constitucional, es decir los Derechos Humanos expresados en diversos convenios que el país ha firmado. Summary The situation of childhood and the adolescence in the Republic of Argentina as object of social politics is discussed from a clinical point of view. This matter seems to be connected to the problems of (personal) security, sometimes mingling the barrier that separates this from the way Justice functions and the legal instruments. The tendency is to believe that the punishment itself rehabilitates, diminishing the problems of transforming intervention upon the so-called “penal guaranty” without including with identical force the substantial guarantees having constitutional rank, that is Human Rights stated in all kind of conventions that the state has signed. |
