| مستخلص: | El caso Agreal se caracteriza por un conjunto de daños por sus efectos adversos en mujeres. Es relevante judicialmente, tanto por el número de demandantes o presuntas víctimas como por las dificultades periciales, que han sido y están siendo de dos tipos: 1) Múltiples y complejas cuestiones farmacológicas a dilucidar; 2) Resistencia obstruccionista de los diversos y cualificados peritos de Sanofi-Aventis a aceptar cualquier evidencia probatoria que implique su responsabilidad. Retirado en España, prohibida su dispensación, desde septiembre de 2005, y en la Unión Europea desde el 1.X. 2007, lo anterior podría ser considerado solo testimonial, sino fuera porque las mujeres que han sufrido sus efectos adversos neuropsiquiátricos aún tienen derecho a ser reconocidas como víctimas de daños por Agreal y a ser indemnizadas. De lo contrario ante los demás y ante ellas mismas podrían quedar como personas ávidas de abusar de su penosa circunstancia y de la publicidad dada. Es relevante para los derechos de las mujeres no solo porque las víctimas presuntas o confirmadas son todas mujeres, sino porque los peritos de Sanofi argumentan que la mujer peri y post menopáusica está biológica y psicológicamente en riesgo de sufrir trastornos e inventadas “manifestaciones psicofuncionales” que el prospecto indicaba Agreal “curaría”, siendo en realidad reacciones adversas. The Agreal case is due to the adverse effects in women of this prescription drug. This legal case is relevant both by the great number of possible victims as for the difficulties to clarify all the different issues of the legal trials. Those difficulties are mainly of two kinds. 1) The many and complex pharmacological issues to make them clear and evident beyond any reasonable doubt; and 2) above all, the obstinate resistance of all the Sanofi-Aventi experts’ in Spain to accept any possible responsibility. The drug was removed of the market and forbidden in Spain in September 2005 and in the European Union since the 1st October 2007. But what is especially important on this regard is that the women declared to have been victims of the side effects of Veralipride by the tribunals of justice must receive indemnities and to be recognized as victims of this medically used drug. This case has affected many women, but what is now unacceptable is that the experts of Sanofi-Aventis, the producer of the medicament in Spain, have maintained that the post menopause women are biologically and psychologically at risk of suffer disorders that Veralipride would “cure” instead of producing them. |
