| مستخلص: | The authors present in this occasion a study directed to the theoretical-practical behavior related with the complex topic of collatable donations in the Cuban positive Law system. For this purpose the historical bases of collation inherited, as well as the dogmatic analyses that have allowed the configuration and characterization of this figure in the native order have been projected. Assisted by an exegetic analysis of the Cuban Civil Code, the authors end up demonstrating the main successes and mistakes present in today’s regulations and law practice. For this purpose they contribute with study to the best interpretation and application of the precepts related with the institution they are talking about. Los autores presentan en esta ocasión un estudio dirigido al comportamiento teórico-práctico relacionado con el complejo tema de las donaciones colacionables en el sistema de Derecho positivo cubano. Para ello se han proyectado sobre las bases históricas de la colación hereditaria, así como los análisis dogmáticos que le han permitido confi gurar y caracterizar la fi gura en el ordenamiento patrio. Auxiliados de un análisis exegético del Código Civil cubano llegan a demostrar los principales aciertos y desaciertos que en la normativa y en la práctica jurídica de hoy están presentes, para lo cual asisten con este estudio en la mejor interpretación y aplicación de los preceptos relacionados con la institución que comentan. |
