| مستخلص: | Diese Arbeit beschäftigt sich mit dem Problem des privaten Parteifinanzierungsrechts im Rahmen der Demokratie, insbesondere hinsichtlich der Vereinbarkeit und den Grenzen bezüglich privater (Groß)spenden. Dies erfolgt am Beispiel des Istzustands der Regulierung in Deutschland und Ecuador unter besonderer Berücksichtigung ihrer jeweiligen leges specialis (PartG und LOE). Die Fragestellung der Arbeit lautet: Wie verhindern diese Rechtsordnungen, dass sich eine (undemokratische) Wirtschaftsmacht illegitim als politische Macht etabliert und wenn ja, mit welchem Schwerpunkt und warum? Ziel der Arbeit ist es, eine Grundlage für den Dialog zwischen beiden Rechtssystemen zur Verfügung zu stellen Dafür wird auf ein höheres Verständnis der rechtlichen Regeln und Ordnungsmuster abgezielt, die diese bestimmten Gesellschaften antreiben. This research document deals with the problem of private party financing law in the context of democracy, in particular with regard to the compatibility and the limits of (large) private donations. This is done using the example of the current state of regulation in Germany and Ecuador, taking particular account of their respective special legislation (PartG and LOE). The research question is: How do these legal systems prevent an (undemocratic) economic power from being illegitimately established as a political power and, if so, with what focus and why? The aim of the work is to provide a basis for the dialogue between the two legal systems. To achieve this, a better understanding of the legal rules and patterns of order that drive these particular societies is aimed at. Esta investigación aborda el problema de la legislación sobre financiamiento de los partidos políticos en democracia, en particular con respecto a la compatibilidad y los límites con de las (grandes) donaciones privadas. Esto se hace utilizando el ejemplo del estado actual de la regulación en Alemania y Ecuador, teniendo en cuenta sus respectivas leyes especiales (PartG y LOE). La pregunta de investigación es: ¿cómo evitan estos sistemas legales que un poder económico (no democrático) se establezca ilegítimamente como un poder político y, de ser así, con qué enfoque y por qué? El objetivo del trabajo es proporcionar una base para el diálogo entre los dos sistemas legales. Para lograr esto, se busca una mejor comprensión de las reglas legales y los patrones de orden que impulsan estas sociedades particulares. |
