| مستخلص: | In this article we discuss the discursive functioning involved in the edition of Precedent 610-STF. Although it has no binding effect, this Precedent has governed decisions in different Brazilian courts since then. Continuing a discussion on the inadequacy of its normative content, proposed by Moreira et al. (2019), in this article, we ask ourselves about the conditions of enunciability that guaranteed its emergence and its consolidation. To this end, we proceed to the analysis of the enunciative scene involved in / by the texts that underlie the five HCs that substantiate the edition of the epigraphed Precedent, based on a discursive-ergological approach. Questioning the statements in the context of work of criminal justice, we find an enunciative scene in which the values of two legal assets are confronted: life and heritage. The discursive functioning that establishes this confrontation points to a structuring feature of the legal system that, aligned with capitalist rationalities, associates the right to life with the right to property. Resumo: Neste artigo discutimos o funcionamento discursivo implicado na edição da Súmula 610-STF, que, embora não tenha efeito vinculante, tem regido as decisões nos diferentes tribunais brasileiros desde então. Na continuidade de uma discussão sobre a inadequação de seu conteúdo normativo, proposta por Moreira et al. (2019), neste artigo nos perguntamos sobre as condições de enunciabilidade que garantiram o seu surgimento e a sua consolidação. Para tanto, realizamos a análise da cena enunciativa implicada nos/pelos textos que fundamentam os cinco Habeas Corpus que consubstanciam a edição da Súmula epigrafada, com base em uma abordagem discursivo-ergológica. Questionando as enunciações no contexto de trabalho jurídico penal, encontramos uma cena enunciativa em que se confrontam os valores de dois bens jurídicos: a vida e o patrimônio. O funcionamento discursivo que estabelece este confronto aponta para um traço estruturante do sistema jurídico que, alinhado a racionalidades capitalistas, associa o direito à vida ao direito à propriedade. Resumen: En este artículo discutimos el funcionamiento discursivo implicado en la edición del Sumario 610-STF que, aunque no tiene efecto vinculante, ha regido las decisiones en los diferentes tribunales brasileños desde entonces. Continuando con una discusión sobre la inadecuación de su contenido normativo, propuesta por Moreira et al. (2019), en este artículo nos preguntamos sobre las condiciones de enunciabilidad que garantizaron su surgimiento y su consolidación. Para ello, realizamos el análisis de la escena enunciativa implicada en los/por los textos que fundamentan a los cinco HC que sustentan la edición del Sumario epigrafiado, desde un abordaje discursivo-ergológico. Cuestionando las enunciaciones en el contexto del trabajo jurídico penal, encontramos una escena enunciativa en la que se confrontan los valores de dos bienes jurídicos: la vida y el patrimonio. El funcionamiento discursivo que establece este enfrentamiento apunta a un rasgo estructurante del sistema jurídico que, alineado con racionalidades capitalistas, asocia el derecho a la vida con el derecho a la propiedad. |
