مستخلص:	Apesar de a saúde pública estar consagrada como direito fundamental, desde 1988, vislumbra-se, no Brasil, um desencontro entre os mundos deôntico e ôntico, quanto ao tema em questão; e um dos motivos são as vulnerabilidades históricas, semânticas e relativas às minorias. Assim, o presente artigo problematiza o enunciado do artigo 196 da Constituição, buscando incitar uma reflexão sobre os motivos da sua não concretização. A hipótese de trabalho é a de que a ideia de igualdade tradicional obsta a concretização dos direitos das minorias. Trata-se de uma pesquisa de caráter bibliográfico, utilizando-se de um método argumentativo. A hipótese de trabalho é confirmada, ao pugnar por uma ressignificação da saúde pública. Although public health has been enshrined as a fundamental right since 1988, there are signs, in Brazil, of a mismatch between the deontic and ontic worlds regarding the subject in question; and one of the reasons are the historical, semantic and minority-related vulnerabilities. This article problematizes the statement of article 196 of the Constitution, seeking to incite reflection on the reasons for its non-implementation. The working hypothesis is that the idea of traditional equality hinders the realization of minority rights. It is bibliographic research, using an argumentative method. The working hypothesis is confirmed as striving for a new meaning of public health.
