| الوصف: | Como consecuencia de las transformaciones políticas y económicas de las últimas décadas, con la sustitución del modelo del Estado Social por un modelo de corte neoliberal, se ha producido en el campo del derecho el abandono de un derecho resocializador garantista (con todas sus carencias) y la apuesta por un derecho de tipo vindicativo. La fórmula actual de este derecho vindicativo que corresponde al modelo neoliberal es el populismo punitivo. En la presente investigación queremos hacer una primera aproximación panorámica de este fenómeno jurídico tanto en su dimensión histórica, económica y política como discursiva. Por ello, nuestra intención es, por un lado, presentar el marco histórico político-económico que ha posibilitado y en el que se ha desarrollado el populismo punitivo contemporáneo, y para ello se ha realizado una aproximación al marco histórico del final de la Guerra Fría y de la Postguerra Fría que han producido fuertes cambios en el mundo tal como lo conocimos. Un mundo que ha entronizado el sistema capitalista en su vertiente neoliberal como hegemónico, las políticas neoconservadoras y que ha llevado a la aparición de nuevas guerras, todo ello con una fuerte influencia en el sistema punitivo. Por otra parte y derivado de lo anterior, hemos querido prestar atención a dos discursos políticos que han monopolizado el rumbo de la política de las últimas décadas: el neoliberalismo y neoconservadurismo, marco político en el que se ha desarrollado el populismo punitivo. Por último haremos un breve repaso uno tipología de casos que han servido de caballos de Troya penal y que han sido utilizados para difundir el populismo punitivo, como son la utilización de casos sobre menores, sobre mujeres, las nuevas tecnologías, la inmigración, la guerra, las protestas sociales y la crisis o el desarrollo. As a result of the political and economic transformations of recent decades, with the replacement of the Welfare State model by the neoliberal model, what has taken place in the field of law is an abandonment of a resocializing and protectionist right (with all its deficiencies) and the commitment on a vindictive type of right. The current formula of this vindictive right corresponding to the neoliberal model is punitive populism. In this research we want to make an initial overview of this legal phenomenon both in its historical and economic as in its political and discursive dimension. Therefore, our aim is, on the one hand, to present the historical political-economic framework that has allowed the contemporary punitive populism and in which it has developed, and to realize this, there has been made an approach to the historical context of the end of the Cold War and post-Cold War that have produced vast changes in the world as we knew it. A world that has enthroned the capitalist system in its neoliberal way as hegemonic, neoconservative policies and has led to the emergence of new wars, all with a strong influence on the punitive system. On the other hand, and derived from the above, we wanted to pay attention to two political speeches that have monopolized the political course of the last decades: neoliberalism and neoconservatism, the political framework in which the punitive populism has developed. Finally, we will take an overview to a typology of cases used like penal Trojan horses that have been used to spread the punitive populism, as are the use of cases on minors, women, new technologies, immigration, war, social protests, crisis or development. |
