Se la presunzione d’innocenza non è violata da una condanna basata unicamente sulla testimonianza della vittima, purché la sua assunzione avvenga nel contraddittorio tra le parti e il giudice dia conto in motivazione delle conclusioni raggiunte, i diritti dell’accusato e il principio di parità delle armi sono compromessi qualora la vittima sia contemporaneamente parte processuale e testimone. |
