الوصف: Le 25 janvier 2009, les Boliviens ont approuvé une nouvelle constitution définissant leur pays comme un « État social unitaire de droit, pluri-national et communautaire » et en augmentant les droits de la majorité boliviènne, c'est-à-dire de sa population indigène. L'article présente et analyse un long texte de 411 articles en précisant le système décisionnel, qui accorde un rôle important à la population.
On 25 January 2009, the Bolivians approved a new constitution defining their country as “the United Social State of Pluri-national Communitarian Law” and increasing the rights of the Bolivia’s majority of indigenous population. The article presents and analyses a lengthy text of 411 articles through its decisionmaking system, which is granting a significant role to the people.The new constitution has remodeled the former Bolivian administrative division and has introduced a multi-layered autonomy system. Therefore, a certain degree of cooperation is required between public institutions such as a dialogue between the legislative, executive and judicial branches in the process of appointing to the highest state positions. The same system of check and balances is mandated for the ratification of international treaties, for enactment of laws or in the constitutional revision process. On the other hand, the new constitution introduces a reciprocal control mechanism, which also implies a collaboration of several branches and guarantees against arbitration of one branch. However, the keystone of the new constitution is a strong position of the Bolivian citizens, in particular, of the indigenous population, which has been excluded from the decision-making for a long time. The constitution has placed them in the centre of the political arena and has given them large prerogatives. Accordingly, the text introduces a popular election of the executive, legislative and also judicial state authorities and engages the citizens in a participatory decision-making by reserving them the possibility to trigger a referendum, initiative or recall.The complex institutional structure of the new Bolivia’s constitution may be a major step towards the integration of the indigenous people. Yet, its credibility will be shown only after the legislative process of implementing the new constitutional text is finished.
