Pozoren pogled pa pokaže, da so bila nekatera njegova opazovanja – in napovedi o prihodnji podobi »skupnosti prava« v Evropi – precej bolj natančna, kot pa so bile slike danes na splošno bolj cenjenih avtorjev, tudi Kelsna. Prispevek je za Revus močno spremenjena različica uvoda v avtorjevo knjigo L’Europa del diritto (Evropa prava), ki je pravkar izšla pri italijanski založbi Mulino.
Schmitt’s famous lecture On the condition of the European legal science from 1943-1944 is worth of being re-read today – and that for three major reasons elucidated by the author of this commentary paper. First, Schmitt brought attention in his text to a certain European legal identity built of two main sources: the Roman legal science and the English liberal constitutionalism. Both of them have contributed concepts and institutions to what Schmitt has named a European Rechtsgemeinschaft. This “community of law” has had a fortunate future. The term itself has been taken over by the institutions of the European Communities. Its content, on the other hand, has gained a paradigmatic nature and may thus be found today all over the world. The English liberal constitutionalism had spread with the 18th and the 19th century revolutionary movements over Europe, and later over the world. The Roman legal science as developed at the universities of the Middle Ages, on the other hand, has gained its influence because it constituted what may be called a common legal grammar. Even though the reception of the Roman law itself has not reached all the European countries, the Latin language of Corpus iuris has functioned as lingua franca and has thus contributed greatly to developments of scholars of natural law, ius gentium, and even universal or general jurisprudence of Hobbes, Bentham, and Austin. Law, rights, norm, sovereignty, obligation, sanction, etc.: all these terms are common to the Roman law, the English common law, and the codified civil law. Working with these terms, the legal science is thus the source of law par excellence, and the custodian of the European legal consciousness and cultural identity. This identity and consciousness were endangered, however, with the growing dominance of legal positivism. The remedy for it shall not be looked for in some natural-law school, nor in what is known today under the name of neoconstitutionalism. For Schmitt, the only proper thing to do is to return to Savigny, who was the founding father of international civil law. Schmitt’s lecture draws in fact two images of the European legal culture: the past and the future. While the first (as one has seen) is quite familiar, the latter may be even more so. It is made of the legislator, the legal doctrine, the courts, and the constitution. Consequently, Schmitt’s analysis appears to be particularly credible for present times – more credible, at least, than visions of a Kelsen or other fashionable authors.
