| الوصف: | Cet article étudie la nature et les effets du processus d’internationalisation des mouvements de protection de l’enfance entre 1890 et 1939, et leur rôle dans l’affirmation du concept des droits de l’enfant, tout particulièrement dans l’élaboration d’outils juridiques innovants en matière de droits sociaux. Il évoque l’émergence de mouvements spécialisés sur ce terrain à partir de la fin du xixe siècle, puis les relations qui se sont nouées entre divers réseaux concurrents au sein du Comité de Protection de l’Enfance créé par la Société des Nations en 1925 autour de la promotion de certains dispositifs modèles de politiques de l’enfance ; l’analyse est ici tout spécialement centrée sur le processus qui leur a permis de rédiger les premiers projets de conventions internationales visant à garantir de nouveaux droits aux enfants étrangers dans leur pays de résidence. En dépit de leur échec, ces projets sont dignes d’attention car ils annoncent le processus de convergence des politiques sociales européennes, en posant le principe de l’égalité d’accès aux systèmes de protection sociale pour les étrangers et les nationaux. This article examines the nature and effects of the internationalization process related to child welfare movements between 1890 and 1939, and their role in the affirmation of the concept of children's rights, particularly in the development of innovative legal tools intending to assert children’s social rights, i. e. international conventions on the protection of foreign children in their country of residence. It evokes the emergence of specialized milieus in this field from the late 19 th century, and the relationships established between various competing networks in the Committee of Child Protection created by the League of Nations in 1925 around the promotion of childhood policies models. The analysis is focused on the process that allowed these actors to draft several conventions guaranteeing new rights for foreign children in their country of residence. In spite of their failure, these projects deserve attention because they prefigure the convergence of post-war European social policies, by highlighting the necessity to grant equality of access to social welfare rights both to foreigners and national population. |
