For a long time there has been a prevailing opinion among Italian jurists that excludes the power of the judge to control the adequacy of the organisational choices on the basis of which the employer can exercise his legal powers vis-à-vis the employees. However, some normative interventions in recent years, which have attributed to the judge, in relation to various matters, the power to assess the adequacy of the employer’s organisational choices, seem to lay the foundations for overcoming the traditional view. |
