The legal-political debate on telework in Germany has been rekindled by a bill to legislate on specific provisions for telework, including an employee right to telework. Thus, fundamental rights, the peculiarities of the employment relationship, the role of the social partners and the degree of flexibility of the already existing provisions are at the centre of the debate. German labour law, being characterised by a certain stability, seems to be reluctant to precipitate legislative interventions. Does this reluctance risk making it too rigid to cope with current trends in the world of work ? |
