الوصف: | Le contrôle juridictionnel de l’Administration au Cameroun est-il dualiste ou moniste ? Contrairement à la France où « le dualisme juridictionnel » relève d’une « conception radicale de la séparation des pouvoirs », au Cameroun, ce dualisme est modulé. On y relève des emprunts au système moniste avec, d’une part, et malgré la présence progressive des magistrats administratifs, un rattachement du ministère public près les juridictions administratives à celui des juridictions de droit privé, et, d’autre part, sur le plan de la formation des magistrats, une présence encore importante des juges privatistes. Cette situation qu’on peut justifier par la volonté d’assurer l’efficacité de l’action administrative et surtout les difficultés économiques ne garantit certainement pas l’efficacité de cet organe. Des améliorations semblent alors nécessaires. Under Cameroonian law, the judicial control of administration is not a perfectly dualistic system. Unlike in France, where "jurisdictional dualism and the division of powers that proceeds from it" are part of a "radical conception of the separation of powers" in Cameroon, this dualism is modulated. It includes borrowings from the monist system with, on the one hand, an attachment of the state council’s office to that of the private courts, and, on the other hand, in terms of the training of magistrates, a still important presence of privatist judges. This situation, which is no doubt a consequence of the country's economic context does not guarantee the effectiveness of this jurisdiction and therefore requires improvements. |
