| الوصف: | L’objectif de cette contribution est d’identifier les réponses réglementaires que l’ordre juridique de l’UE peut offrir pour protéger les travailleurs face aux processus algorithmiques. En se concentrant sur le cadre actuel qui donne un rôle de premier plan au RGPD et sur la proposition de règlement sur l’IA en cours de discussion, il s’agit de montrer que cette construction réglementaire repose sur les pierres angulaires de la transparence et du contrôle humain, ainsi que sur le choix d’un modèle basé sur le risque, orienté dans une perspective d’approche conjointe et nourri par la Directive 89/391 concernant la protection de la santé et de la sécurité au travail. The aim of this essay is to identify the regulatory answers that the EU legal system can offer to the protection of workers in the face of algorithmic processes. Focusing both on the current framework, in which a leading role is played by the GDPR, and on the proposed AI Act under discussion, the analysis highlights how the construction of the regulatory architecture is based on the cornerstones of transparency and human control, as well as on the choice of the risk-based model, which must be oriented in a joint approach perspective, as nurtured by the impact of Dir. 89/391 concerning the protection of health and safety at work. |
