| الوصف: | La presente investigación tiene como propósito principal analizar la relación entre la Política Criminal y varios actos paradigmáticos de la desobediencia civil en el contexto de Puerto Rico. Más específicamente, se desea examinar cómo el Estado, a través de la norma penal, se relaciona con los fenómenos históricamente reconocidos como desobediencia civil en esa jurisdicción. Se evaluará, a su vez, cómo estas normas penales se vinculan con el ordenamiento constitucional y legal en Puerto Rico, el cual se bifurca en dos jurisdicciones diferentes -federal y territorial- dentro de un marco particular de relación con los Estados Unidos de América. De esta manera, se pretende concluir y proponer unos límites tanto legales como político-criminales a la regulación normativa de estos fenómenos de protesta como formas de expresión de disidencia política. Investigar la reacción político-criminal ante este tipo de modalidad de protesta es, a su vez, auscultar las concepciones de varias categorías e instituciones vinculadas a lo político en Puerto Rico. Depurar críticamente esas concepciones es una condición para proponer los límites normativos que este trabajo se apresta a realizar como fin constructivo. |
| الوصف (مترجم): | This dissertation aims to analyze the relationship between the criminal policy and several paradigmatic cases of civil disobedience in the jurisdiction of the Commonwealth of Puerto Rico. More specifically, it has the purpose to examine how through criminal law the Government deals with historically recognized cases of civil disobedience in this territory. In addition, this research will analyze how these criminal laws are related with the constitutional and legal order in Puerto Rico, which is divided between federal and state jurisdiction within a particular framework of political relationship with the United States of America. Through this investigation we can conclude and propose some legal and normative limits to the state regulation of this protest phenomenon as political dissent. Furthermore, to examine the reaction of criminal policy regarding this type of protest involves analyzing the concepts of various political categories and institutions in Puerto Rico. This last task is a previous condition to propose the normative limits that this research hopes to offer as a constructive purpose. Programa de doctorat en Dret |
